The Kiwi Passion Consortium announces the successful and awaited precautionary ruling of the Court of Bologna, which recognized the full validity of the RS1 variety protection - distributed under the Red Passion brand - whose marketing has been conferred to the Kiwi Passion Consortium, as well as the exclusive right to disseminate, develope and market by the consortium's Licensor inhibiting the marketing to two entities based in Castel Bolognese (Ravenna), through an accurate procedure of genetic and documentary analysis among the first and most in-depth in the fruit and vegetable sector in Italy and certainly in the kiwi world.
"The Consortium, also through delegation to its consortium members, is taking actions to request the recognition of the right to be compensated for damage for an activity that has greatly slowed down the development of the variety (a market leader) and which always presents a very high demand by consumers", explains Kiwi Passion.
"Furthermore, communications will be sent shortly to invite the producers who have purchased the variety in the possession of the losers and who, currently, are in limbo, as having the cause of companies to which any activities on the consortium variety".
"There remains the bitterness for the need for a dispute that has affected the activity attributable to the president of a competing consortium. We are confident that, from now on, we can witness a more transparent evolution of the kiwi market in Italy, especially by those who propose to take on representative positions", conclude from the Consortium.
